The Bombay high court on Tuesday directed the CBI to file a reply within two weeks to a petition challenging the order of the governor refusing sanction to prosecute former CM Ashok Chavan in the Adarsh society scam.

A division bench of justice PV Hardas and justice AS Gadkari directed the agency to file its affidavit while hearing a petition filed by former journalist Ketan Tirodkar.

Citing an SC order to oppose the clean chit to Chavan, Tirodkar said the CBI does not require sanction from the governor to prosecute public servants in cases which are being monitored by the judiciary.

Tirodkar filed the application after K Sankaranarayanan refused permission to the CBI to prosecute Chavan.

Chavan was accused of approving additional FSI to Adarsh housing society in South Mumbai in exchange of two flats for his relatives.

He was also charged with illegally approving the allotment of 40 per cent of the flats for civilians when the society was meant for Kargil war widows and defence personnel.
