The Bombay city civil and sessions court at Dindoshi recently ordered the demolition of the encroached portions of a 14-storey commercial building on Link Road at Andheri (West).

The order passed by judge AJ Mantri says the civic authorities’ approval to the builder violates provisions of Maharashtra Ownership of Flats Act, 1963 (MOFA) and Development Control (DC) Regulation.

Srikrishna commercial complex came up next to Kartik building and the distance between the two is not more than six feet.The plaintiffs are four owners of Kartik building. They allege that Sangeeta Ramchand, the builder at the time of selling units , had not mentioned anything about building Srikrishna. Ahmed Abdi, advocate representing the plaintiffs, said that Ramchand started building Srikrishna complex in 2008 by demolishing the boundary wall of Kartik building, without taking the unit owners’ written consent. “The builder did not inform the unit owners at the time purchasing it,” said Rajiv Wagh, another advocate. Ramchand refuted the allegations, saying the plaint is only to harass her.
