Mumbai: Youth gets life term for raping 6-year-old boy

A sessions court on Monday sentenced a youth in his mid-twenties to life in prison for kidnapping and then sodomizing a six-year-old boy in 2015.

The child had been beaten up and taken away by Farukh Shaikh when he had gone late at night to buy chocolate from a shop near his home. While his parents kept looking for him and then registered a kidnapping complaint with the police, the next morning a taxi driver brought the child home. The victim was hospitalized for fifteen days due to the assault.

Deposing before the sessions court, the taxi driver Mehrab Shaikh told the court that he had found the child who was bleeding from his nose and crying at Eastern Free Way near Wadala. When he asked the child where he lived, the child was unable to tell the address. Then, Shaikh had told him names of some nearby areas and the child had recognized one name out of those as that of his area. Shaikh had then taken the child around the area and the child was able to guide him to his home.

At home, the child had told his father that he was in pain and narrated about the sodomy. Special Public Prosecutor Ashwini Rayakar said that the child could not depose in court as whenever he had been summoned, he was either under trauma, unwell or family circumstances did not permit him to come.

"We argued that when the child is so young, they tend to not remember the instances and not deposing would also save the child the trauma of recollecting the incident," said Rayakar. The father of the child had given his testimony.

Rayakar further said that the DNA samples from the clothes of the child, which contained blood and semen, matched with that of the accused.
