Mumbai: Renting out a flat? You don't need police's NOC

A tweet from the Mumbai police cleared many doubts on Friday, as it stated that a landlord or a tenant did not have to get a no-objection certificate from the police for renting a property. Just telling them about it is enough.

"There is no requirement of obtaining an NOC from Mumbai police before renting out your flat/house," the tweet posted on Friday by the Mumbai police read.

"You only need to intimate the nearest police station about the details of the tenant in the prescribed format. You don't even need to visit the police station and can send the form via post, courier or email," it read.

A message accompanying the tweet said: 'Break the nexus of the unscrupulous property/estate agents. Follow the rules & complain to senior officers or on the following link if asked to do otherwise: http://bit.ly/WebComplaints."

The Mumbai police's twitter handle further clarified that this is applicable throughout the state.

When one of the users pointed out that there are housing societies that ask for a stamped form by the police as proof of rental, the police replied: "Show them our tweet."

Normally during registration of a leave and licence agreement, brokers charge two fees — the brokerage, and small fees which includes registration and getting the NoC document from the police.

Alisha Coelho, who stays on rent in Mumbai, said, "In a flat I had rented earlier, the housing society had asked for a stamped document from the police station. The broker took all the details from me as well as that of the landlord and it was handed over to the society. He charged a nominal fees for this."

Another twitter user, who has had to get an acknowledgement letter from the police, said, "Last time, the society asked for a police verification letter with a stamp. I didn't know the rule but an agent did it for me. Now I want to rent out the same property and have already sent the police's tweet to the society," said Nilesh Panchmatiya.

Vikram Mehta, president of real estate body Property PPL, said, "The police would catch the broker or the society management in case there was any mishap concerning a tenant. So a broker provides this service. We take all documents, get them stamped from police, and give it to the society. We do it so that there's no trouble."

ENOUGH SAID

Mumbai Police spokesperson Sachin Patil said, “We only need to be intimated. There is no requirement for an NOC. In case any society asks for documentation from police, this tweet is sufficient to answer all their queries.”
