According to an estimate, there are over 60,000 housing societies in the state where developers have not conveyed the land.
The state government on Monday approved amendments to the Maharashtra Ownership Flats Act, 1964, making it mandatory for developers to convey land to housing societies within four months of the society being registered.

The reason builders are reluctant is that if the land is not conveyed, benefits from any future development on it go to the builder and not the society.
The bill provides for penal action against developers who do not comply. According to the new rules, the flat buyer can approach the district deputy registrar (DDR) if the developer fails to form the society and grant the conveyance of land and building of the society within six months of receipt of application.
In case he fails to adhere to DDR’s order, the buyer can file a complaint with the local magistrate. Separate guidelines are being framed authorising the DDR to debar such developers from construction activity for five years.
About conveyance of individual societies in a layout plot or a big complex, the government has said it will frame separate guidelines to govern this transfer.
The proposed guidelines will make it possible for a developer to convey the land without forming a federation or apex body, unless all the societies in the layout plot want to have conveyance in the name of the federation.
Moreover, the builder won’t be able to deny conveyance under the pretext of balance floor space index (FSI) potential pending in the plot. Official sources said the proposed guidelines will also make it mandatory for developers to hand over the conveyance to the building in proportion to the FSI/TDR used in respect of the particular society.
