Mumbai: Goregaon-based doctor to pay Rs 10 lakh to Lower Parel local for botched surgery

The state consumer disputes redressal forum recently ordered a Goregaon-based doctor to pay a compensation of Rs 10 lakh, to a Lower Parel resident, who lost her mother because of the botched surgery of the doctor. The commission has ordered the doctor to pay the compensation along with nine per cent interest rate on the amount from the year 2002. The commission has also levied an additional fine of Rs 25,000 against the doctor.

The case dates back to the year 2001, when Geeta Mangaonkar, was admitted to Tushar Maternity surgical nursing home as she had to undergo a surgery for removing stone in gall bladder and Common Bile Duct (CBD). Accordingly an Endoscopic Retrograde Cholangio Pancreatography [ERCP] was carried out on the patient, however, the surgery went wrong, as the doctor failed to locate the stones. The doctor finally passed on the case to KEM Hospital for further operation. Accordingly on November 14, 2001, the surgery was carried out by KEM Hospital on the patient. However, since the patient was already suffering with septicemia, thus she passed away on November 27, 2001.

Meanwhile, looking at the serious condition of the patient, the complainant's father Ravindra Mangaonkar passed away on November 25, 2001. Thus, Dhanashri Savardekar, the daughter of the duo approached the consumer forum and filed a case against the doctor, seeking compensation.

The commission on going through the complainant's version asked the doctor to file his reply, to which the doctor claimed that all the allegations leveled against him were of frivolous nature and that there was no negligence committed on his part. Doctor's say read, "Complainant failed to bring on record any independent expert opinion in support of her claim. He is an experienced General Surgeon from GS Medical College of Mumbai and worked as associate professor of surgery and Unit head of surgery unit at KEM Hospital with sufficient experience to his credit. He claimed that he was not at fault and did not lack in performing the surgery.

The commission after going through the detailed versions, held that the doctor was well aware of the medical conditions of the patient and even after that he directed the patient to undergo second surgery, which thus lead to her death.
