Mumbai: Collector issues appeal to lease holders to renew lease or says govt will take over property

The notice also informs that the property will be taken by the government and the buildings on the land will be handed over to the state government if not renewed.

The Mumbai city collector has sent out a public appeal informing all lease holders of government land that a final hearing of those who haven't yet renewed their lease will be held on October 24. In the year 2016, the collector had asked all the lease holders of government land in his jurisdiction to renew the license, there were close to 600 such properties, of which close to 300 have been renewed and an equal number haven't yet come ahead. The notice also informs that the property will be taken by the government and the buildings on the land will be handed over to the state government if not renewed.

The appeal was signed by the collector, S Jondhale. When contacted, Jondhale said, "We issued the public notice because there are more than 300 lease holders who haven't yet renewed their lease. We have decided to give a hearing to people and know what action to be taken ahead. While we know where the structures are but in some cases the original landlord cannot be traced, we have asked even the tenants who are residing there to come forward and renew the lease. If they fail then action as per the procedure shall be taken. Most of the properties are 100 years old."

The appeal reads, "According to the Government Resolution dated December 12, 2012, of state of Maharashtra, it is decided that in the District of Mumbai City, whichever lease has expired those properties will be renewed according to the resolution. The notice according to this resolution has already been issued. Whichever lease holders address has been changed or not available were informed through advertisement dated October 4, 2016 in the newspaper, but still there is no response for renewal. Also whoever has not responded in this has been given notice by sticking at the leased property, even then till date there is no response to the collector."

The appeal further stated that, "If anyone intends to state anything about the property then they are called on October 24, 2018 at 11 am at conference hall of district collector office, wherein the public assembly for hearing will be taken and it is also required be given in writing. Otherwise according to section 53 of Maharashtra Land Revenue Act 1966, the property will be taken by the government and also according to section 54 the buildings on the land will be handed over to teh state government as per the rule and procedure."

The properties are located at Bhuleshwar, Colaba, Mazgaon, Malabar Hill, Parel, Sewree, Mahim, Girgaon, Fort and other areas.
