On September 8, the CAT had quashed the I&B ministry’s decision to remove Banerjee from the post of CEO of the Children’s Film Society of India (CFSI).
After being rapped for the ‘clumsy’ removal of IPS officer Sushovan Banerjee, the ministry of information and broadcasting (I&B) on Monday was asked to pay Rs25,000 by the Central Administrative Tribunal (CAT) for not reinstating him in time.
On September 8, the CAT had quashed the I&B ministry’s decision to remove Banerjee from the post of CEO of the Children’s Film Society of India (CFSI). Actor-director Nandita Das headed the society. The CAT had ordered immediate reinstatement of Das.
Banerjee, a 1989 IPS from Madhya Pradesh (MP), had moved the CAT challenging his sudden repatriation order. He was sent on a three-year deputation to CFSI, Mumbai, in December 2008. The I&B ministry, however, repatriated him to MP on April 26
this year. The charge against him: he did not work in harmony with Das.
Earlier this week, the ministry moved an application seeking time to reinstate Banerjee. Peeved by the ministry’s contention, the tribunal said, “No good ground is forthcoming….justifying the extension of time.” The CAT also said that the ministry’s action would be liable for contempt proceedings but, taking a lenient view, it imposed a cost of Rs25,000.
Banerjee’s advocate Sandeep Marne had argued that the ministry had removed Banerjee based on ‘verbal complaints’ without elaborating who had complained.
Observing that the deputation of an officer “cannot be considered to be so tentative and vulnerable as to throw him out at the whims and fancies of a particular person, and that too without any notice and without adhering to the principles of natural justice”, the CAT had overruled his removal.
