Also directs chief secy to ensure it is implemented.
Seeing little or no action taken by the authorities concerned in demolishing unauthorised structures in the city and its neighbouring districts, the Bombay high court has directed the chief secretary to formulate a comprehensive policy to tackle the menace and ensure that it is implemented.
A division bench of justices DY Chandrachud and RD Dhanuka on Friday also directed the chief secretary to take action against the unauthorised structures.
The collectors, forest conservators in Thane district and all municipal corporations are directed to prepare plans to remove illegal constructions.
The judges also rapped the government for its lackadaisical attitude on the issue. “Had the government been serious, this (mushrooming of unauthorised structures) wouldn’t have happened. It doesn’t happen because of poor people, it is because of nexus between corrupt (municipal) corporation officials and developers,” said Justice Chandrachud.
The court was hearing a bunch of public interest litigations (PILs) concerning the demolition of unauthorised structures in the state.
The additional government pleader informed the court that there are approximately 2.37 lakh unauthorised structures in Thane district alone. The government has divided these structures into three categories – pre-1995 structures, from 1995 to 2000, and post 2000.
Structures that came up before 1995 are already regularised by the government. The government has also proposed to regularise unauthorised structures that came up between 1995 and 2000. However, the issue is pending in the Supreme Court.
In 2010, while hearing PILs, the HC had directed the authorities concerned to demolish illegal structures in Thane district, including in Vasai, Virar, Navi Mumbai, Mira-Bhayander stretch, Kalyan and Dombivli.
