Driver gets 18 months in jail for killing child in Mumbai
The accused was being treated for drug abuse for three months before the incident.
A 21-year-old driver who had rammed his vehicle into five people, killing a nine-year-old, was convicted and sentenced to a year-and-a-half in prison. The accused, Mohsin Shaikh, has been asked to compensate the parents of the child with Rs30,000 and other two injured victims – Shakil Ahmed, 27, and Javed Khan, 13, – with Rs20,000 and Rs5,000 respectively.The court, which had first convicted him under section 304 II of the Indian Penal Code (culpable homicide not amounting to murder) changed it and convicted him under section 304A (rash and negligent act resulting in death).As per eyewitnesses in the case, on August 12, 2008, around 4 pm, a white Tata Sumo raced towards a paan shop. The car first banged into one of the stationary taxis and then proceeded towards the shop hitting Ahmed, barber Yusuf Balwar, and two children, Javed and Afroze Khan who were playing nearby.The prosecution said the driver also rammed into nine-year-old Sahadiullah Khan. The accused then left his car and ran away. The child was taken to KEM Hospital where he was declared dead before admission.Additional public prosecutor, JV Kenjalkar examined 14 witnesses, including eyewitnesses, doctors who examined the patient and other formal witnesses in the case.
