DNA EXCLUSIVE – Mumbai's Development Plan 2034: Transition policy introduced for real estate

The BMC had earlier assured the realty sector to sympathetically consider earlier concessions accorded for the completion of projects.

In the wake of the implementation of Mumbai Development Control & Promotion Regulations (DCPR) 2034, the Brihanmumbai Municipal Corporation (BMC) on Monday issued a second transition policy. As per the policy, the builders and developers, who had received approvals under DCPR 1991, can convert their plan in accordance with the new provisions without having to revisit the municipal commissioner for ongoing projects. The BMC had earlier assured the realty sector to sympathetically consider earlier concessions accorded for the completion of projects.

Under the new policy, if fire check floor, which are six feet high to prevent fire, is constructed on site as per NOC from the chief fire officer and is approved as per DCPR 1991, the same will be continued free of FSI under DCPR 2034. "As per DCR 2034, fire check floor will not be required. BMC has made it clear that those already constructed, will have to be demolished," the officer informed.

According to DCPR 2034, all staircases for ongoing projects will have to be five feet instead of four feet. A leading developer said, "This transition policy will help ongoing projects to continue unhampered and switch to the new DCPR without any difficulty."

As per DCPR 1991, 25 per cent visitors parking was mandatory. "However, under the DCPR 2034 it has been brought down to 5 per cent because the city has small plots and providing 25 per cent visitors parking was not feasible due to planning constraints. In addition, realty players hardly keep such parking as they always sell to consumers," a BMC officer told DNA.

Earlier, the entire transferable development right (TDR) was permissible as slum TDR, which was easily available. The slum TDR was used to reduce open space deficiency premium. "As per the DCPR 2034, out of the permissible TDR, maximum 50 per cent can be slum TDR while remaining has to be reservation TDR. Those who used 100 per cent slum TDR will not be asked to reduce to 50 per cent as they will continue with their approval of slum TDR so that the project development does not stop."

SMOOTH TRANSFER
