Case in contrast: Illegal floors of Thane building regularised

Unlike the residents of Campa Cola compound in Worli, residents of Vihang Garden at Samatanagar in Thane (West) are a relieved lot. For, the Thane Municipal Corporation (TMC) has regularised the three illegal floors of their building. A commencement certificate (CC) has already been given to the builder and they would receive the occupancy certificate (OC) as soon as the pending work is done.     

The building has 13 floors and 112 flats. It was built by VN Developers, which is owned by Shiv Sena MLA Pratap Sarnaik. Sarnaik had built a primary school for TMC in Sector 6 at Paachpakhadi in Thane (West). For this construction, he used TDR for a 13-storey building.  “However, there was a technical goof-up on our part and instead of completing the school work and then starting the construction of Vihang Garden, we finished the construction of the latter first,” said Sarnaik. 

“We should have built the school first and handed it over to TMC. However, we have got the CC now and will soon get the OC after we comply with the other norms prescribed by the civic body,” he added. 

“We were staying in fear of not getting the OC for the past three years. Our fear worsened after we saw the plight of the Campa Cola residents,” said Urmila Malwankar, a resident of Vihang Garden.

The TMC issued CC to VN Developers on October 31 regularising the four illegal floors.  “They still need to do some pending work like the building parking lot and other things. Once done, we will issue them an OC and the building will become legal,” said Jitendra Bhopale, additional director, town planning, TMC.

“This is the best Diwali present we could have hoped for,” said Vasant Satpute, another resident.
While the residents are busy rejoicing, Sarnaik still needs to battle it out over the penalty of Rs4.5 crore to be paid to TMC.  “Since we have goofed up technically, we have to pay over Rs4.5 core to TMC,” said Sarnaik.
