Granting relief to the landlady whose premises were being used by her tenant to run a brothel, the Bombay high court recently ordered the Pune commissioner to reconsider her case before sealing her premises.
The order can be beneficial to owners of leased premises who may be unaware what their property is being used for. Under the Immoral Traffic (Prevention) Act, 1956 when a place where prostitution is raided by the police it is ceased and can be released only after the order of a magistrate.
“Most times the property remains sealed for at least a year and the landlord is deprived from using it for any purpose,” explained additional public prosecutor DP Adsule.
The court was hearing the petition filed by Pune-resident Sushila Karkunwar, 50, who had rented out her property to one Urmila Tamang in Budhwar Peth. Karkunwar learnt that Tamang was indulging in “immoral activities” from the premises and served an eviction notice to her on August 3 this year and terminated their lease dated July 22. Karkunwar’s property was, however, sealed by the police after they initiated action against Tamang.
