The Bombay High Court has restrained organisers of Pro Rajasthan Kabbadi league, from using a trademark deceptively similar to the popular, 'Pro Kabaddi League'.

Though, Justice S J Kathawala, in his order passed on July 18, allowed the organisers S K Kuntal, who is the chairman of Pro Rajasthan Kabbadi league, to use the trademark 'Rajasthan Kabaddi or Rajasthan Kabaddi League.

The organisers of the Pro Kabaddi League, Mashal Sports Private Limited had approached the court, seeking an injunction against the Rajasthan league, claiming the trademark and logo used by them, is deceptively similar to theirs. The use of their registered trademark and logo will affect their goodwill and reputation.

The plaintiff also said that they had made correspondence with the Rajasthan league organisers, but since there was no positive response, in order to protect their registered trademark, they had moved the court.

Advocate Hiren Kamod appearing for the defendant said "We filed a consent term in the court, agreeing to not use the word Pro, in our trademark. Destroy all material in our possession have the deceptively similar trademark. Not use the domain name which was similar to that of the plaintiff. Also not advertise through various social media portals, the deceptively similar mark."
