The Bombay high court on Tuesday directed the Central Adoption Resources Agency (CARA), to review within two weeks the six applications of foreign nationals, all from European countries, wanting to adopt children having special needs.

The adoptions were stalled after the agency did not give a no-objection certificate, even though the adoption coordination committee had given a go-ahead.

Seven petitioners had moved the high court saying that the objection by CARA was not correct. Accordingly, the advocate appearing for the child welfare committee informed the high court that one of the petitioners had withdrawn his application stating the delay as one of the reasons. To which the bench of chief justice Mohit Shah and justice S Vazifdar said “See what your insensitivity can do”.

The advocate further informed the court that there are six cases and eight children who are awaiting the go-ahead for adoption. To which the bench noted, “You still treat them as cases and not children. This approach will seriously affect the children and adopting parents.”

While hearing another petition filed by Preet Mandir, an adoption agency, whose license has been suspended in May last year, after the CBI registered a case against the managing director of the agency, the court directed CARA to file its reply by March 3.

The counsel appearing for Preet Mandir said “CARA has, on the basis of the case registered by CBI, suspended our license. The FIR is only against one person. Moreover, the agency can control us, but should not stop us”.
