You are too late in complaining about copyright violation, the Bombay high court told Feroz Khan Films Pvt Ltd, while declining to restrain makers of the film Thank You from using the song 'Pyaar Do Pyaar Lo'. The movie is releasing today.

Justice Dhananjay Chandrachud was hearing a suit filed by Feroz Khan Films, producers of the film Jaanbaaz in which the song was originally used. Its petition stated that it owns the copyright of the song and the producers of Thank You, UTV Productions, have not purchased it.

Chandrachud said, “There has been a gross and unexplained delay on the plaintiff’s part in filing the suit.” He also noted that FK Films got to know that the song is being incorporated in Thank You on March 3, 2011, and “is approaching the court today”.Advocate Ashok Sarogi argued that FK films assigned music rights of Jaanbaaz to Music India Limited on December 11, 1984, but only for a period of two years. “After two years, the copyright returned to FK Films,” he added.

“Why are you using his (FK Films) song in your film?”

Chandrachud asked UTV’s counsel Dinyar Madon. “Because we have purchased the rights from the company he (FK Films) sold the songs to,” replied Madon. He added that the agreement between FK Films and Music India did not specify any time frame and that it had purchased the copyright of the song from Music India in August 2010.

Chandrachud said there is no case made out for the grant of ad interim relief at this stage when the movie is scheduled for worldwide release on Friday. The judge also noted that the producers have spent Rs60 crore. The judge directed UTV to file its reply and posted the matter for hearing to June 28.
