Bombay High Court allows expansion of Byculla Zoo

The Bombay High Court on Thursday, rejected a petition filed by Mafatlal Industries Limited, seeking compensation from the Brihanmumbai Municipal Corporation, to hand over a seven-acre plot of land in Byculla. This is likely to pave way for the expansion of the Veermata Jijabai Bhosale Udyan (Byculla Zoo).

A division bench of Justice SC Dharmadhikari and Justice Bharati Dangre turned down the plea and refused to stay its order, to allow the company to challenge it in the Supreme Court. The land was handed over to the corporation in 2017 by the state government after the lease entered with the company had expired. The zoo authorities plan to construct an enclosure for a hippopotamus on the plot.

According to the Urban Development Department in 2004 and the title certificate submitted by the legal counsel of Mafatlal Industries Limited (MIL), land measuring around 14 acre was leased out to MIL in 1913 for a period of 99 years. However, half of the land amounting to around seven acre was reserved as an extension to the Byculla Zoo.

Senior Advocate Anil Sakhare and Advocate Rohan Mirpury opposed the plea by questioning the validity of the claim raised by the company as the lease had expired. It was argued that since the land belongs to the collector, the company should give possession to the corporation, without any cost.
