Observing that no grounds have been made out by the applicant to be granted bail on medical grounds, the Bombay High Court on Thursday rejected an application filed by former deputy chief minister and NCP leader Chhagan Bhujbal, who has been arrested for his alleged role in the Maharashtra Sadan scam. Justice P N Deshmukh, while turning down the application, directed the prison authorities to provide him with necessary medical aid as Bhujbal has been found to be suffering from several chronic ailments like hypertension, diabetes, cardiac ailments and others.

Bhujbal had sought bail on medical grounds claiming that he was suffering from serious ailments and did not want to take the risk of being provided treatment only after something had happened. He wanted to take precautions instead and, on the advice of his doctors from Hinduja hospital, he had sought three months' temporary bail.

Amit Desai, Bhujbal's counsel, had pointed to several discrepancies in the report submitted by the nine-member medical board constituted on the high court's directions. However, the court refuted the discrepancies and accordingly dismissed the plea.

In May, the court had directed the dean of JJ Hospital to constitute a medical board of a minimum of three doctors to examine Bhujbal, before it decided on the temporary bail application filed by the leader.

Bhujbal and his nephew Sameer are in judicial custody at present, following their arrest in connection with a Rs840-crore money laundering case filed by the Enforcement Directorate (ED). Bhujbal had earlier said the case was "concocted'' against him.

The case filed by the ED concerns a contract for the construction of Maharashtra Sadan in Delhi and alleged land grabbing at Kalina in Mumbai. Bhujbal had moved the high court for bail on medical grounds.
