Adarsh scam: 'Kanhaiyalal Gidwani was appointed coordinator for alloting land'

The appointment of Kanhaiyalal Gidwani as the coordinator of controversial Adarsh CHS did have a cost attached with it, revealed the cross-examination of RC Thakur, chief promoter of Adarsh CHS.

Thakur on Wednesday informed the two-member commission set up to probe the alleged Adarsh CHS scam that, Gidwani was appointed as co-ordinator to deal and represent the society and co-ordinate for the society for the exclusive purpose of allotment of land to the society, through a declaration-cum-undertaking dated June 9, 1999. 

“It is also mutually and specifically agreed by us being the office bearers and managing committee of the society that at any time in future if the extra Floor Space Index (FSI) and Transfer of Development Rights (TDR) are granted to the society, all such FSI and TDR shall be utilised by the said co-ordinator at his sole discretion for which the said society its office bearers and the managing committee members shall have no right or interest in the additional FSI and/or TDR,” said the undertaking.

At the same time, it was also mentioned in the undertaking that, the building/s that will be developed and constructed on the said plot of land will consist of as many flats as permissible within the FSI and TDR limits of the Government of Maharashtra and Brihanmumbai Municipal Corporation (BMC) and it has been mutually agreed by and between the managing committee and office bearers of the society and the said co-ordinator that the minimum 70 flats shall be reserved for the promoter’s quota and shall allotted to the erstwhile members of the society and whatever the remaining flats will be retained and at the disposal of the said co-ordinator.

Thakur informed the commission that, after the allotment of the land, the society’s stand was changed and instead of entire additional FSI and TDR which was to be granted to the co-ordinator, Gidwani, it was agreed to grant partial additional FSI to the extent of allotment of number of members.

“The change of ratio was 60-40%, meaning thereby that the 60% members of the society would be brought by the society and 40% by Gidwani,” said Thakur.
