Rajasthan High Court ordered an interim stay on the state government’s orders that had put a stay on the school to charge increased fee while also taking back the NOC of the school.
Providing relief to Vidhyashram School, the Rajasthan High Court ordered an interim stay on the state government’s orders that had put a stay on the school to charge increased fee while also taking back the NOC of the school.
Along with this, the court has asked the parents who has appeared in the court to deposit the fees according to the old fee structure by June 10. The court has observed that in case the fee is not deposited, the school administration will have full discretion to take action. Moreover, the court has kept the hiked fee under the decision of the application.
The division bench of Justice Manish Bhandari and Justice DC Somani gave the order while conducting hearing on application filed by Bhartiya Vidhya Bhawan’s side. It was said in the application that the applicant increased the fee as the costing had also increased on which the DEO ordered a stay on April 19. Moreover, on April 30, the Education Department issued the order and took back the NOC issued to the school.
It was said in the application that the staff is being provided with the benefits of the seventh pay commission. Apart from this the state government provides Rs 17,000 per students under the RTE whereas the real expense is several times more and only Rs 200 per student is being charged for the facility of digital board. Apart from this, the board’s trustee are providing their services without any salary.
It was said in the application that the school does not take grant from the Government and under this situation the Fee Regulation Act does not get implied on the school.
