Lower courts stays disrupt Dravyavati work progress

Orders of subordinate courts and JDA tribunals are becoming impediments in the fast progress of the ambitious Dravyavati river project. JDA’s attempt to complete this in the stipulated time has come a cropper as lower courts have often been overstepping their jurisdiction limits to hear cases on Dravyavati project. 

“We have requested subordinate courts not to do so and have apprised them of honourable High Court’s order in which it had asked lower courts not to do so,” said JDA Commissioner Vaibhav Galriya. Dravyavati river’s beautification is priority of state government. Chief minister Vasundhara Raje has instructed Vaibhav Galriya to complete the project by August 15. However, several court cases have raised doubts about timely completion of the project.

The work is affected on at least 10 places because of court cases. The work has been closed in 1400 meter area. The problem for engineers is that Zone Deputy Commissioners are not paying serious attention to the court cases because of that JDA has been receiving dates after dates. The engineers have been trying to resolve the pending cases on their own without any success because of lack of support from zone level. If these cases are not resolved soon, JDA’s efforts to complete the project could be in jeopardy.

Not a single matter has a stay from the High Court. Majority of stay are from JDA tribunal disrupting the progress. Remaining cases are from district court or other subordinate courts. The HC on August 1, 2016 said that subordinate courts have no right to hear cases related to Dravyavati River. Yet, lower courts have been interfering in Dravyavati river’s matters, which is violation of the High Court orders.

  • Appellate tribunal, JDA – A matter of 300-metre area in zone 9 is pending but no stay
