The Supreme Court will hear on Friday the appeal filed by former Haryana director general of police SPS Rathore challenging his conviction and 18-month sentence in Ruchika Girhotra molestation case.

A bench of justices P Sathasivam and BS Chauhan will also take up the plea moved by Rathore for his release either on bail or on parole pending disposal of his appeal by the apex court.

The Punjab and Haryana high court had on September 1 dismissed Rathore's appeal challenging his conviction and the
sentence for molesting teenager Ruchika Girhotra two decades
ago, saying his conduct as a top official was "shameful".

Justice Jatinder Chauhan had also dismissed a petition by
68-year-old Rathore, who is undergoing the sentence in high-security Burail Jail, Chandigarh, since May 25, seeking
release on probation.

The sessions court had earlier enhanced his six-month imprisonment awarded by a trial court in December last year to
18 months in jail on an appeal by CBI and Ruchika's family.

Rathore's escape with a lighter sentence had sparked an outrage.

Ruchika, a budding tennis player, committed suicide three years after being molested by Rathore on August 12, 1990.

Rathore's lawyer-wife Abha Rathore had filed the review petition on his behalf in the high court on May 26 seeking bail, a day after he was sentenced and jailed.

However, the high court dismissed his plea with the stinging remark that "he should have acted as a guardian of the society but his act was shameful". 

Rejecting his plea for release on probation, the judge had said "there were certain mitigating factors for taking a lenient view for his (Rathore''s) release on probation like his old age, heart ailment, protracted trial, ailment of his daughter and his unmarried daughters and there are certain aggravating factors as well like his official position."
