Supreme Court disposes plea against M Nageswara Rao's appointment

The Supreme Court on Tuesday disposed of a plea challenging the appointment of M Nageswara Rao as the interim CBI Director.

The Supreme Court said that the Selection Committee led by Prime Minister Narendra Modi had given the Government the go ahead to appoint an interim Director for Central Bureau of Investigation (CBI) in the meeting called on January 9, 2019 when Director Alok Verma was removed.

Revealing for the first time what happened inside the meeting attended by PM Narendra Modi, Leader of Congress in the Lok Sabha Malikarjun Kharge and Supreme Court judge Justice AK Sikri (nominee of CJI), the apex court made public the operative part of the minutes of the meeting which showed how by majority, the Committee approved the selection of an officer to hold fort till a new Director is appointed.

The verdict came on a plea of NGO, Common Cause, which had challenged the appointment of Rao as interim CBI director.

The bench said, "It is apparent from the decision of the Committee that the Government was authorized to post a suitable officer as interim Director. Thus the submission raised in the petition that the Committee has not authorized the appointment of interim Director is totally misconceived...and the petition has been filed in undue haste without verifying the fact."

Interestingly, Bhushan had submitted to the Court that the decision of the Committee was sought under RTI but was refused. The Court refused to pass any direction to this effect. However, it dismissed the petition on the ground that nothing survived in the petition after a regular Director was appointed on February 2.
