Supertech urges SC to modify its judgment, seeks stay on demolition of one tower

Real estate company, Supertech has moved the Supreme Court on Wednesday seeking modification of the court's August 31 judgment. The apex court in its judgment had directed the demolition of the 40-storey twin-tower building of Supertech's Emerald Court project in Noida.

Supertech has urged the Supreme Court to modify its judgment wherein only one of the two towers be demolished while the other is kept intact. In its application, the real estate company cites that the demolition of only T17 will ensure compliance with minimum distance requirements and the national building code.

Proposing an alternative plan, the company said that it is not challenging the legality or substance of the judgment but only seeks a modification to save 'crores of rupees'. The Supreme Court in its August 31 judgment had ordered the demolition of both the twin towers - T16 and T17.

Along with this, the developer has stated that it will establish a green zone at the demolished site and allocate flats to all those in T16 who have still not withdrawn their allocations. Supertech Limited has by way of an interim measure, sought status quo on the entire demolition exercise till the case is heard and decided by the top court.

The Supreme Court had earlier pulled up Supertech saying 'collusion between the developer and the planning authority' was 'writ large' in the illegal construction of housing towers in Noida. Upholding the Allahabad High Court order for the demolition, the Supreme Court initiated criminal proceedings against the builder.
