The two had first moved the court for discharge from the case on the ground that the CBI had stated in its chargesheet that Parmar and Sharma had played no active role in the case.

There was no meeting of minds between the two constables and the main conspirators, and they had acted merely on the instructions of their superior officers DG Pandian and Rajkumar Pandian, the CBI chargesheet says.

The two had argued that, for this reason, their names should be removed from the list of the accused, and they be discharged from the case. However, their petition was rejected by the magistrate's court.
