Around 50 families from Girgaum have been homeless for the past seven years. The reason: Their housing society was demolished for redevelopment but, following several disputes with the builder, work hasn't been completed and the families are yet to be given possession of their houses.
A blame game has ensued between the families and builder, with both pointing fingers at each other for the inordinate delay in the project.
In 2003, 50 families of the Narendra Sadan co-operative housing society, at Mugbhat Cross Lane in Girgaum, signed an agreement with Vardhaman Lifestyle Developers over redevelopment of their society. "According to the original plan, each family was to get a 225 sqft flat and an additional 20 sqft free. If anyone wanted more area, they would have to pay extra to the developer," said Kishor Vaze, a resident.
Work started in 2007 and the existing structure was demolished. However, after the construction had begun and the first plinth had been installed, a government resolution (GR) was passed, which said that in a redevelopment project the minimum area allotted should be 300 sqft.
"We then spoke to the builder and approached Mhada for a no-objection certificate (NoC) to avail the free extra area sanctioned by the government," Vaze said.
This is where the dispute started — the families believed they were eligible for the extra area under the new government rules (which say if only the first plinth has been installed, 300 sqft should be allotted, but not if work has progressed beyond that), while the developer said that as the agreement had been made before the GR was passed the families were not eligible.
Managing director of Vardhaman Lifestyle Developers Rajesh Vardhan told dna that Mhada has not issued any NoC till date. "In spite of this, I went ahead and, in the absence of an NoC, I had to use the surplus area to construct the building," Vardhan said.
However, senior advocate Unnikrishnan, representing the affected families, said Mhada had issued the NoC last year and yet there has been a delay in the project. "There are two agreements — the development agreement and the permanent alternative accommodation agreement. He (developer) hasn't registered either," Unnikrishnan said.
He alleged that the developer took extra money from some families and promised them particular flats in the building. "But those very flats have been sold to third party," Unnikrishnan said.
Vaze said he was promised flat no. 1201. "I had even paid extra for additional area in it. But now, I have found out that that flat has been sold to some other person and also registered in their name," he alleged.
Vardhan, however, said, "I never stopped the work; it has been delayed because the residents wanted extra area. And now they are alleging that I am delaying... I am the real victim in this project."
