Rajiv Gandhi convict moves Madras High Court
The premature release of the prisoners was in connection with the commemoration of former chief minister MG Ramachandran's birth centenary.
Rajiv Gandhi assassination case life convict Nalini Sriharan has moved the Madras High Court challenging section 435 of the Criminal Procedure Code provision which prevents the Tamil Nadu government from releasing those convicted in CBI investigated cases.
Nalini has moved the court in the wake of the Tamil Nadu government issuing an order dated February 1 allowing the premature release of the convicts who completed 10 years imprisonment, except those coming under the section 435 of the CrPc. The premature release of the prisoners was in connection with the commemoration of former chief minister MG Ramachandran's birth centenary.
"After my death sentence was commuted to life on April 24, 2000, about 2,200 life convicts who had served 10 years of imprisonment or less were released by the Tamil Nadu Governor on the ground of their good conduct. However, I have not been considered for premature release only on the ground that my case falls under the section 435 of the CrPc," her affidavit said.
