President Ram Nath Kovind issued a proclamation for President's rule in Jammu and Kashmir under article 356 of the constitution of India
President's rule has been imposed in Jammu and Kashmir after the six-month governor's rule came to an end on Wednesday.
President Ram Nath Kovind issued a proclamation for President's rule in Jammu and Kashmir under article 356 of the constitution of India. Unlike other states, Jammu and Kashmir is first placed under governor’s rule for six months under special provisions.
Since the six month period ended on December 19, President Ram Nath Kovind issued a proclamation wherein he assumes all the functions of the government and all powers vested in or exercisable by the governor under the constitution and the state constitution.
President Kovind said he has received a report from the governor and he was satisfied that the situation has arisen in which the government of that state cannot be carried on in accordance with the provision of the constitution of India as applicable to that state and of the constitution of Jammu and Kashmir.
The governor’s rule came into force on June 20, a day after PDP-BJP coalition government collapsed after the latter pulled the rug prompting the Jammu and Kashmir chief minister Mehbooba Mufti to put in her papers. Former J&K governor NN Vohra had placed the assembly in suspended animation which was dissolved by the incumbent governor Satya Pal Malik on November 21 amid high political drama.
“Now therefore in exercise of the powers conferred by article 356 of the constitution, and all other powers enabling me in that behalf I hereby proclaim that I declare that the powers of the legislature of the said state shall be exercisable by or under the authority of parliament”, said President Kovind in his proclamation. Union Ministry of Home Affairs (department of Jammu and Kashmir affairs) later issued the formal notification about the imposition of president's rule in the state
