PNB scam: Cases against Mehul Choksi 'bad in law', his lawyers tell court

Choksi's lawyers submitted his medical reports to justify the claim that he is not in good enough health to travel to India to face legal proceedings.

Fugitive diamantaire Mehul Choksi's lawyers on Friday told a special court in Mumbai that the legal proceedings against him are bad in law. The submission also included reports from a doctor in Antigua, to where Choksi had fled, advising him not to travel.

The submissions by Choksi's lawyers were made to a special court hearing cases under the Prevention of Money Laundering Act (PMLA). Choksi is wanted in the massive Punjab National Bank fraud case, which is estimated to run in excess of Rs 14,000 crore.

Choksi's lawyers - Vijay Aggarwal and Ashul Agarwal - claimed in their submissions to the special court that the legal proceedings against their client had no basis in law. 

They also submitted Choksi's medical history and recent doctor's recommendations to justify Choksi's reported inability to travel to face his court proceedings. They submitted 38 documents, including latest prescriptions and certificates. The submissions included a medical certificate dated February 27 by a Dr HA Morcos in St John's, Antigua. The submission claimed that the doctor has strongly recommend that Choksi avoid travelling.

The court has adjourned hearing in the matter to April 9.

Choksi presently lives in Antigua, where he has acquired citizenship. His submissions to the court come just days after the arrest of his nephew and co-accused Nirav Modi. Modi was arrested in London on Wednesday, and is presently in custody. A London court had denied him bail, and is set to decide on his extradition.

The Enforcement Directorate (ED) has also started the extradition process for Choksi. He was the owner of Gitanjali Group, which deals in jewellery. He had fled India after the scam surfaced.
