Noida: 40-floor residential twin towers to be razed, flat owners to get refund

The Supreme Court on Tuesday ordered the demolition of Supertech's twin 40-storey towers in the Emerald Court project in Noida for violation of building norms. The Apex Court upheld the order passed by the Allahabad High Court directing the demolition.

Terming it as an 'unholy nexus' between the builders and the Noida authorities, a two-member bench of Justices DY Chandrachud and MR Shah directed that the entire amount of home buyers be refunded with 12% interest from the time of the booking. It has also directed to pay the Residents Welfare Association Rs 2 crore for the harassment caused due to the construction of the twin towers.

As per the Supreme Court orders, the demolition exercise of the twin towers has to be carried out within three months under the supervision of NOIDA and an expert agency. The Bench clearly stated that the entire cost of this has to be borne by Supertech Ltd.

Supreme Court bench clarified that the construction of Supertech's twin towers with 915 flats and shops was done in collusion with New Okhla Industrial Development Authority (NOIDA) and the Allahabad High Court was correct in holding that view.

On August 4, the Supreme Court had reserved its verdict on the matter. During its hearing, the bench of Justices DY Chandrachud and MR Shah reprimanded NOIDA authority saying it is reeking with corruption and had connived with the builder over not providing the sanctioned plan to the homebuyers of Supertech's Emerald Court project.

The bench pointed out that when the homebuyers asked for the plan, the authority wrote to the developer on whether to share it or not and refused to give the plan to them at the developer's behest.
