The judge at the Mumbai Sessions Court tells Salman Khan that "you were behind the wheel."
Bollywood superstar Salman Khan was on Wednesday sentenced by a sessions court to five years' rigorous imprisonment in the 2002 hit-and-run case, but he swiftly moved the Bombay High Court which granted him interim bail till May 8 to hear his appeal against conviction.
Justice Abhay Thipsay granted interim bail to the actor after observing that the accused had not been given a copy of the conviction order by the sessions court.
Salman has been convicted under Section 304 A of the Indian Penal Code (rash and negligent driving); 279 (rash driving); 337 (causing minor injuries); 338 (causing major injuries) 427 (negligence) in connection with the case. Under Motor Vehicle Act Sections 34 (a), (b) read with 181 (driving vehicle in contravention of rules); 185 (driving at great speed after consuming alcohol).

"The urgency in the matter is that the appellant (Salman) who was on bail throughout the trial is likely to be taken into custody today. However, the copy of the order has not been delivered yet," Justice Thipsay observed. The Judge said, in all fairness and in the interest of justice, it would be proper to protect Salman Khan for the time till a copy of the order is furnished to him.
"The order could have been pronounced when the copy was ready. Why was the order pronounced today? It should not have been delivered if the copy is not ready," Justice Thipsay said.
The judge also directed the actor to execute a fresh bond before the trial court today itself.

Lawyer Harish Salve argued in the court that no one can be put in jail without proper order. So far, Salman's lawyer has only recieved operative part of the court order, not the full order. Opposing his plea, government pleader Sandeep Shinde said the High Court should not entertain the actor's plea without a copy of the conviction order. He said the accused had not enclosed the copy of the order in his appeal as required under law.
Bombay HC has subsequently given 2 days' interim bail to the superstar.

Background
The popular actor was tried afresh under the harsher charge of culpable homicide not amounting to murder which is punishable with imprisonment upto 10 years.
A Bandra Metropolitan Magistrate, who conducted the trial under lesser charge of rash and negligent driving, which carries a maximum punishment of two years, had in 2012 slapped the more serious offence of culpable homicide and committed the matter to the sessions court.
The actor has claimed he was not at the wheel at the time of the accident which killed one person and left four others injured on the night of September 28, 2002.
While the prosecution has insisted that a drunk Khan was driving the Toyota Land Cruiser that ran over the victims sleeping on the pavement outside a bakery in suburban Bandra, the actor has claimed it was his driver Ashok Singh who was behind the wheel. Driver Singh has endorsed the defence's claim.
