The Bombay High Court on Friday directed the setting of an independent three-member committee to study the Kamala Mills fire that took place in December 2017. The move comes after the court rapped the state government for not setting up a committee by itself.
A division bench comprising Justice RM Borde and Justice Rajesh Ketkar said that the committee will comprise a retired judge, an architect from the HC panel, and an individual or retired government servant well-acquainted with town planning rules.
“The genesis of the violations at Kamala Mills by various establishments will be studied considering the original development plans of the area,” the HC observed.
The court passed the order after the BMC had opposed a public interest litigation (PIL) filed by former top cop Julio Ribeiro, who had sought the setting up a special judicial commission to probe the fire that killed 14 people on the midnight of December 28. The court recorded reasons separately for allowing the constitution of the commission.
The BMC had said at this point there is no need for judicial inquiry because the Municipal Commissioner had himself filed a detailed affidavit and conducted an inquiry into the incident of fire. Even the reports of lapses and irregularities recorded by various departments and its officers are attached to the report. Action against erring officials is ongoing, so there is no need for an independent inquiry at the moment.
The state government had left it to the court for deciding on the prayer made in the PIL and said it would adhere to court orders. “On paper, everything is alright, but in practice it is not correct, or-else this incident would not have happened,” the bench observed.
Ribeiro in his petition sought the inquiry by the judicial commission to account the lapses committed by government officials, and direction to the authorities to conduct a fire audit of all restaurants and pubs. A total of 14 people died in the incident.
