The Delhi high court sought response from the Election Commission the Bahujan Samaj Party on a petition seeking cancellation of BSP election symbol Elephant alleging its misuse by party chief Mayawati.
The Delhi high court on Wednesday sought response from the Election Commission (EC) and the Bahujan Samaj Party (BSP) on a petition seeking cancellation of BSP election symbol Elephant alleging its misuse by party chief Mayawati.
The petition by an NGO, Common Cause, said the Mayawati government in Uttar Pradesh was spending crores to install statues of elephant at various public places in the state.
The NGO approached the court after EC refused to take action against the party for alleged misuse of the symbol and rejected the complaint filed by it against BSP.
“It is illogical and unjust to reject a petition on the ground that the other party had not provided the information sought by the Commission. Moreover, once it was clear to EC that several such statues had been erected at public expense, it was immaterial whether the exact number and locations of such statues were known or not,” the NGO’s counsel submitted.
The court, after hearing the plea, issued a notice to EC and BSP and posted the matter for further hearing to March 17. EC had rejected the complaint filed by the NGO against BSP on October 11.
