An Uttar Pradesh police constable who allegedly shot dead an unarmed man during early hours on Saturday in Lucknow said he acted in self defence as the man tried to run him over.

38-year-old Vivek Tiwari, an assistant sales manager of Apple India, was in a car with a former woman colleague when the incident took place.

"At 2 am last night, I saw a suspicious car with its lights off. When I approached the car, the driver (Vivek Tiwari) tried to run me over thrice to kill me. I fired a bullet in self defence, he then immediately took off from the spot," constable Prashant Kumar said.

Tiwari was shot at by the policeman around 2:30 am in Lucknow’s Gomtinagar extension area and later succumbed to his injuries. Constable Prashant and his colleague Sandeep Kumar were arrested after police registered an FIR on the woman’s complaint.

"Police personnel was detained yesterday after he shot at a car on noticing suspicious activity, injuring driver of the vehicle. On seeing police, he tried to flee and rammed his car against a wall. He later succumbed to his injuries. Postmortem report to determine the cause of death," a senior police officer said.

Senior superintendent of Lucknow Police Kalanidhi Naithani said the constable fired in self-defence. “The constable (Prashant) fired in self-defence believing that some criminals were inside the car as the victim tried to flee after hitting the patrol bike,” the SSP said, according to a news report.

Reacting to the matter, Director general of police OP Singh said initial findings suggest that the constable acted beyond the limit of self defence and added that a fair investigation will be done.

Kalpana Tiwari, the wife of the victim, said police had no right to shoot at her husband and demanded Chief Minister Yogi Adityanath to talk to her.

Another family member sought a CBI inquiry in the matter.

"Was he a terrorist that police shot at him? We choose Yogi Adityanath as our representative, we want him to take cognizance of the incident and also demand an unbiased CBI inquiry," Vishnu Shukla, brother-in-law of deceased Vivek Tiwari, said.

Deputy Chief Minister Keshav Prasad Maurya said action will be taken against those found guilty.

"Investigation is underway. If an innocent person has been killed by the police probe will be done. Action will be taken against those found guilty," Maurya said.
