The Gujarat high court on Tuesday rejected two petitions, both filed by Imtiaz Pathan, a witness in the Gulbarg Society massacre case.

In one petition, Pathan had sought the cancellation of suspended deputy superintendent of police (DySP) KG Erda's bail on the ground that he had a played a role in the massacre.

In the other petition, he had sought the court's intervention to make three people, namely Manish Patel, Jagrup Rajput and Mahendra Pukhraj, accused in the case. Pathan had alleged that there was ample evidence to prove that all the three had a hand in the Gulbarg society massacre.

While rejecting Pathan's petition seeking cancellation of Erda's bail, the high court observed that Erda had not violated any of the conditions on which he was granted bail.

Further, there were no complaints against him alleging misconduct, the bench said. The high court rejected Pathan's plea saying that the prosecution had not complained against Erda nor had it asked for cancellation of his bail.
