Gujarat high court asks for clear guidelines for deportation of Bangladeshis

The Gujarat high court has asked the state and the central government to come out with a clear procedure of law meant for detention and deportation of the foreign national residing illegally in the country.

A division bench of the Gujarat high court consisting of chief justice SJ Mukhopadhaya and justice Akil Kureshi has demanded proper guidelines after the petitioner civil rights organisation, Jan Sangharsh Manch (JSM), contended that the police are not following proper guidelines, while dealing with the Bangladeshi migrants.

During the hearing of the petition on Monday, the state government contended that, they are following all guidelines relating to the issue and that the central government has also delegated power to deal with foreign nationals residing illegally in the country.

However, Mukul Sinha and Rajesh Mankad, counsels for JSM, contended that, the government is not following guidelines. The illegal foreigners should be produced before the foreigners' tribunal and they can not be treated as an accused and taken into the police custody. During the hearing, counsel for the central government also said that, they have delegated the powers to the state government to deal with such issues.

The JSM has filed a petition regarding the issue of deportation of suspected Bangladeshis residing in Siyasatnagar colony near Chandola lake. The Special Operation Group (SOG) of the city police had arrested and deported over 47 persons to Bangladesh.
