Gujarat HC issues notice to RERA, govt over appointments

The court directed the government as well as the authority to file their replies in the matter by July 8.

The Gujarat High Court’s division bench of Justice SR Brahmbhatt and Justice AP Thaker, on Tuesday, issued a notice to the state government and the Gujarat Real Estate Regulatory Authority in connection with a petition questioning the appointment of chairman and members of the authority, as well as the decisions taken by it in the past one year.

The court directed the government as well as the authority to file their replies in the matter by July 8.

The petitioner Title Investigators and Conveyancing Advocates’ Bar Association through its advocate DK Puj has challenged the appointments on the ground that they were made in contravention of the Real Estate Regulatory Authority (RERA) Act.

The association has contended that the selection committee for the appointments was not formed and the qualifications required for the positions were also not considered.

The petitioner has demanded that the appointments should be nullified by the court.

It has also raised questions on the appointment of ‘legal service provider’ by the authority as it was not done following the competitive bidding process.

The petitioner has alleged that the eligibility criteria for the legal service provider was finalised in such a manner that only a few big law firms can qualify.

It has been also alleged that majority of these law firms have a conflict of interest as they work with various major developers across the state.

Apart from questioning the empanelment of lawyers by way of issuing a public notice, the petitioner-association has also raised the grievance about the way the authority manages its website. The next hearing of the matter is scheduled on July 8.
