After the Gujarat high court's decision to quash two Public Interest Litigations against Ketan Desai's senate berth today, all eyes are once again on the Gujarat University administration and principal secretary of higher education Hasmukh Adhiya.

For vice-chancellor Parimal Trivedi though, the high court's decision comes as a huge relief. "It proves that our stand on Ketan Desai's candidature wasn't an unlawful decision, we have just followed the Gujarat University Act," said Trivedi, who has already referred the matter to Adhiya.

Now, the ball is once again in Adhiya's court. The governor of Gujarat had ordered the principal secretary of higher education to look into Ketan Desai's uncontested senate seat issue on November 26. Following the suit, the university has also decided to refer the matter to him on December 7.

Adhiya has been waiting for the high court's decision on two PILs before giving his verdict. Playing safe on the controversial issue, Adhiya today made it clear that he is studying all the legal aspects of the matter, before reaching a conclusion. He has even asked the university to submit further information related to the senate election and the University Act. "I have already asked the university to submit further information, and I will take at least a week before coming to a conclusion," added Adhiya.

Experts blame the lack of clarity in the University Act to be the reason behind the delay. The university wanted the government to take a final decision as per the section 58(2) of the Gujarat University Act, 1949. According to this clause, the government can intervene in matters related to the university's senate election. The state government has every right to decide the 'eligibility' of any elected candidate, and further, the decision taken by the government shall be abiding to everyone and will be considered as final.
