Maharashtra government, in a bid to ensure growth in land markets with reduced litigation and ease in land based banking, proposes to introduce a system of titling and registration of title by amending the Maharashtra Land Revenue Code, 1966. The mechanism for land titling, which is touted to be buyer friendly, hopes to give security to the title and rights of person owning, purchasing or receiving property. This apart, the proposed amendments will also provide easy accessibility of information related to immovable properties and transactions to the buyers.

State revenue department officer told DNA, "As on date there is no system of recording titles over the property by a public authority and it is left to the purchaser to investigate and come to his own decision about the title of the property intended to purchase. This decision is subjective to him and not conclusive. As a result, uncertainty about title remains forever. Besides the situation restricts the land markets and acts as a barrier to maximum utilization of land as a resources. It also results in increase in multiplicity of litigation as well as its costs.'' He informed that the revenue department has prepared a draft bill to amend the Maharashtra Land Revenue Code, 1966 which is expected to be tabled during the three week monsoon session beginning July 24.

The officer said with the establishment of land title's office all records of immovable properties will be maintained which will serve as conclusive record of titles and thereby bridge the gap between the transaction and updating or records. Further, he noted that the proposed titling mechanism will help protect persons from being defrauded while dealing with immovable properties.

S Chockalingam, state Settlement Commissioner & Director Of Land Records, who was member of the high level committee on land titling appointed by the Centre in 2013, said, ''The land titling will bring a revolutionary change in land administration in protecting property rights of people of India.'' He informed that he is also member of the appointed by the Niti Ayog to prepare  a road map in this regard.
