Delhi Police to decide entry into capital, says SC on Republic Day tractor march by farmers

As agitating farmer unions on Sunday remained adamant on holding a tractor rally in Delhi on Republic Day (January 26), the Supreme court on Monday (January 18) said during a hearing that it is the responsibility of Delhi police to determine who should enter the capital or not.

"We have indicated to the Attorney General and Solicitor General that it's totally up to the police to decide who should enter and who should not. Does the Union of Indian want police to be told that they have powers under the police act?," said the bench, after the Attorney General sought an order against the tractor rally.

The Chief Justice of India then adjourned the hearing in the matter till Wednesday (January 20). 

On Sunday, Swaraj India leader Yogendra Yadav had announced that farmers will carry out a tractor parade along Delhi's Outer Ring Road on Republic Day. He, however, added that the parade will be conducted peacefully with the national flag. He noted that weapons of any kind, inciteful language, and violent actions would be strictly not allowed in the parade. Yadav expressed hope that Delhi and Haryana Police would not cause hindrances to the parade.

"Farmers will carry out a tractor parade with the national flag on the Outer Ring Road of Delhi on Republic Day. Along with jawans, the Kisan will also celebrate the sovereignty of the country," Yadav said at a press conference.

It is to be noted that the government had moved the SC seeking an injunction against the proposed tractor march or any other kind of protest by farmers during Republic Day celebrations.

A three-judge bench headed by Chief Justice of India Sharad Arvind Bobde heard the plea.
