Centre to clear air on stalled appointment of Justice Akil Kureshi

Breaking its two-month silence over the stalemate over the appointment of Justice Akil Kureshi as Chief Justice of Madhya Pradesh High Court, the Centre on Monday informed the Supreme Court that it required two weeks to communicate its decision as the matter was under consideration of the Central government. The Court will hear the matter next on August 2 when the Centre is expected to convey its stand.

It was on May 10 that the Supreme Court Collegium approved the name of Justice Kureshi, presently a judge of the Bombay High Court, to be appointed the Chief Justice of Madhya Pradesh HC. Along with his name, four other recommendations were sent to the Centre. Within a month, all other appointments were cleared, except that of Justice Kureshi.

Later, the Gujarat High Court Advocates Association approached the Supreme Court in a petition alleging delay on part of the Centre to implement the decision of the Collegium. Appearing for the Centre, S-G Tushar Mehta told a bench that the issue is pending with the Centre.

Appearing for the Gujarat lawyers' body, senior advocate Fali S Nariman requested to know how the Centre had gone about with the recommendation. He cited the Memorandum of Procedure (MoP) for Appointment of High Court Chief Justice and said, "The Centre at best is a distinguished communicator. The MoP requires the Union Law Minister to obtain the views of the concerned state government."
