Budding lawyer of Gujarat caught on wrong side of law

Justice Akil Kureshi of the Gujarat high court upheld the decision of the Bar Council of Gujarat (BCG) which denied the license of practice to a budding advocate who enrolled by flouting norms of admission in a law college based in Mehsana.

The college granted admission to one Lovelesh Mulsania who secured 43% in his BCom exams. After completion of his studies at the law college, the boy approached Bar Council of Gujarat (BCG) to get Sanad (license to practice as advocate) a few years back.

However, BCG denied him Sanad as it was revealed that Mulsania got admission into the law college despite having scored below 45% in BCom degree, which is in violation of BCI norms.

The case was then referred to the BCI, which also gave a similar judgment.

During the hearing of the high court, Kamlesh Kotai, counsel for the Mulsania, submitted before the high court that the boy had secured admission by furnishing his all original certificates and he can't be denied Sanad due to  negligence, if any, on part of the college.

According to the norms of the BCI, the 45% marks in bachelors' degree are required during admission, but not while applying for Sanad.

However, Justice Akil Kureshi withheld the decision by observing that rules of BCI can not be overlooked. At the same time the court also cautioned the college and North Gujarat University to ensure compliance of the rules of BCI in the future.

Meanwhile, the court also withheld the orders of BCI in the case of a girl based in Godhra who was denied Sanad as the bachelors'
degree certificate, with which she secured admission in a law college, had been tampered.
