Banned Jamaat-e-Islami knocks on Jammu and Kashmir High Court door

Proscribed Jamaat-e-Islami has knocked at the doors of Jammu and Kashmir High Court praying to quash the centre's notification of imposing ban saying it is the peaceful organisation which had contested elections both parliamentary as well as assembly and has a registered election symbol.

The Ministry of Home Affairs on February 28 had banned Jamaat-e-Islami (JeI) for five years for allegedly supporting "terrorist groups and being involved in the anti-national and subversive activities in the country".

Twenty five days later, an ex-member of JeI Mehraj Azeem has approached the J&K high court challenging the order.

Syed Musaib, the counsel for the petitioner said, the high court has issued notices to union government asking them to reply within three weeks.

"The petitioner is challenging an illegal and arbitrary order, wherein a socio-religious and political organisation has been declared to be 'unlawful association' with immediate effect without specifying the grounds as is mandated under Section 3(2) of Unlawful Activities (Prevention) Act, 1967," read the petition

The petitioner noted that every such notification shall specify the grounds on which it is issued and such other particulars as the Central government may consider necessary.

"Grounds are not opinions or subsidiary evidence, they should comprise of facts which substantiate the notification, it should include particulars with regards to the dates of the offences, details of the FIR's registered by the police or the details of the pending prosecution", the petition said.

Spelling out their contribution, the petitioner said JeI has been in existence for more than six decades with the sole intent of socio-religious well being of the society.

The petitioner said the organisation has been actively engaging itself in voluntary work, one such recent example is that off unfortunate floods of 2014 the organisation played a tremendous role in bringing the sate back on the track.

"The contribution of the JeI in the field of education and other such sectors is commendable. The said organisation had contested elections both Parliamentary as well as Assembly and has a registered election symbol," the petitioner said.
