Abetment to suicide case: Supreme Court grants Republic TV editor-in-chief Arnab Goswami interim bail

Just days after the Bombay High Court refused to grant Republic TV editor-in-chief Arnab Goswami interim relief in the 2018 Anvay Naik abetment to suicide case, Goswami and other co-accused were released today.

The Supreme Court on Wednesday, November 11 heard the bail plea of Goswami and granted him interim bail on a bond of Rs 50,000.

Arnab Goswami's lawyer Harish Salve argued in the court that Anvay Naik's decoration firm was not doing well and therefore was under debt which might have forced him to kill his mother and commit suicide. Salve also said that his client Arnab Goswami has made complete payments to his vendors and the decision of the Raigad police to reopen the case was not legal.

Citing several cases filed against Goswami and Republic TV by Maharashtra police in the recent past, Salve added the abetment to suicide case against Arnab was reopened on the direction of Maharashtra Home Minister Anil Deshmukh.

Salve also urged the SC to transfer the case to CBI and said that heavens will not fall if Arnab is released on bail. 

Senior advocate Kapil Sibal appearing for Maharashtra government however argued that the hearing in the matter is already going on in the lower court.

Justice DY Chandrachud asked Sibal that if the case really requires the police to question Arnab in custody and is there a direct case of abetment to suicide against him. "Is this really a case of IPC 306? Assuming the FIR is the gospel truth and that's a matter of investigation but is not paying up money Abetment to suicide? It will be a Travesty of justice if bail is not granted while FIR is pending Sibal. I too don't want to watch his channel but if a citizen has approached the SC for justice then we will protect the rights of the citizen," said Justice Chandrachud.

On November 4, the Alibaug police had arrested Goswami and two others in connection with the suicide of architect-interior designer Anvay Naik and his mother in 2018. 

After his arrest, Goswami had requested for police custody which the Alibaug chief judicial magistrate Sunayna Pingale denied in a late-night order and sent him to 14 days of judicial custody.
