SC allows Yechury to visit J&K, five-judge Constitution Bench to hear pleas regarding abrogation of Article 370

SC passed orders despite stiff resistance from Centre.

Supreme Court on Wednesday heard a clutch of petitions regarding abrogation of Article 370 in Jammu and Kashmir. It has issued notice to Centre and others and says that a five-judge Constitution Bench will hear all the petitions related to abrogation of Article 370, in the first week of October.The issue of communication blockade in Jammu and Kashmir will be heard next week.

It has also allowed a student from Jamia Milia to allow to Anantnag to visit his parents and has instructed that the person should be provided police protection if required. Despite vehement opposition from the government lawyers, Supreme Court has allowed CPI(M) general secretary Sitaram Yechury to go to Srinagar and meet his party man who is unwell. 

Supreme Court allowed CPI(M) leader Sitaram Yechury to visit J&K and meet his party leader and former MLA, Yousuf Tarigami. Chief Justice of India (CJI) Ranjan Gogoi said "We will permit you to go, you are the general secretary of a party. Don't go for anything else" SC said that if a citizen of the country wants to visit another citizen, we can't restrict them.

Supreme Court said that the visit of Sitaram Yechury should only be to meet party leader Yousuf Tarigami as a friend, and not for any political purpose. SC gave this rider after SG Tushar Mehta said that the visit could be for political purpose. 

Supreme Court also rejected a plea by a petitioner for appointing an interlocutor for Jammu and Kashmir. The orders were passed despite stiff resistance from Centre who said that the Court entertaining such pleas will have cross border repercussions. However, bench of CJI, Justices SA Bobde and Abdul Nazeer refused to change their stance.

Supreme Court has issued notice to centre and Jammu and Kashmir government on all Article 370 cases. Tushar Mehta said that formal notices may have deeper repurcussions and AG Venugopal said that SC proceedings may be raked up in United Nations. 

However, Supreme Court issued notices and hearing will start from October by a five-member judge regarding constitutional validity of abrogation of Article 370. 

Supreme Court also issued a notice to the Centre on the plea by Kashmir Times Executive Editor, Anuradha Bhasin, seeking a direction for relaxing restrictions on the internet, landline, & other communication channels. SC sought a detailed response from the Centre within 7 days.

SC while allowing a student Mohd Aleem Syed and CPI-M General Secretary Sitaram Yechury stated that they will not do anything in J&K other than the purpose of visit for which they were allowed by Court.

The Court said that if they were found to indulge in any activity other than what they were permitted to do, such acts of commission or omission will be seen as a violation of Court order. 

On return, the Court has directed both persons to file a compliance report on the purpose of their visit.

Congress leader Rahul Gandhi on Wednesday hit out at Pakistan for instigating violence in Jammu and Kashmir and asserted that all matters related to the region are India's internal issues with no room for Pakistan's interference.

Gandhi, in a series of tweets, said he disagrees with the government on many issues but made it clear that aspects related to Jammu and Kashmir are internal for New Delhi.

"I disagree with this Govt. on many issues. But, let me make this absolutely clear: Kashmir is India's internal issue & there is no room for Pakistan or any other foreign country to interfere in it," Rahul said in a series of tweets.

"There is violence in Jammu & Kashmir. There is violence because it is instigated and supported by Pakistan which is known to be the prime supporter of terrorism across the world," Gandhi wrote in another tweet.

This comes after Pakistani Minister for Human Rights, Shireen Mazari, on Tuesday said she has a written a letter to 18 UN Special Procedures mandate on Kashmir issue. In her letter, Mazari has claimed that Rahul Gandhi has noted that people are dying in Jammu Kashmir.

Mazari in her letter, which is also posted on her Twitter, to the UN body quoted Gandhi. " ...acts of violence have even been acknowledged by mainstream politicians, such as the Leader of the Congress Party, Mr. Rahul Gandhi who has noted "people dying" in Jammu and Kashmir, in light of events "going very wrong there"," she wrote.- ANI
