Seven Kashmiri students, accused of raising anti-national slogans at the JNU campus on February 9, 2016, had in their confessional statements told the Delhi police that they did not know the three remaining accused — namely Kanhaiya Kumar, Umar Khalid and Anirban Bhattcharya. This was part of the chargesheet filed by the Delhi police on Monday. The police, however, managed to nail their lies via the mobile records and show that they were all in close touch.

The police also claim that the exchanges show the event was being planned for a long time. According to sources, only Muneed and Mujeeb accepted that they knew each other (they are brothers), but others claimed they joined the event after seeing the posters on social media.

Aqueeb told the police that no one had invited him and he didn't know the organisers, even claiming that he had covered his face due to the cold. “The call data record of Aqueeb shows that he had made a call to Umar Khalid, a day before the event.

On February 9, the location of the Aqueeb's number shows that he was in JNU,” stated the chargesheet. Investigations also revealed that Aqueeb was seen holding an 'Azadi' placard and was present at the event along with Khalid, Anirban, Umair, Rayees and Basharat.

Like Aqueeb, Mujeeb also stated that he was not invited, but even his call data records show that he had called up Khalid on his mobile phone on December 28, 2015 at 14:23 pm.” 

The chargesheet also states that Mujeeb had raised slogans glorifying the stone pelters by saying 'Sangebazo wali Azadi'.

Umair Gul, on the other hand, stated that he went for the event after seeing the posters on Facebook. Gul's mobile was also located in JNU on February 9. Meanwhile, Gul was also in constant touch with Mujeeb and on February 7 he had received a call from Mujeeb at 12:15pm following which he started tarvelling towards JNU.

The chargesheet further states that CFSL experts had certified Umar Khalid had forged the signatures of Ashwathi and Anirban on the permission letter.

Speaking to ANI, Sibal said, "There is no need for a sedition law in today's times, it is a colonial law. Many who merely speak or tweet against the government have sedition charges imposed against them; it is being misused by the Centre just to keep citizens in check."

Senior Congress leader Kapil Sibal Wednesday demanded that the sedition law be scrapped as those in power are "manipulating" it. He also called for a change in the government to save the country. "Scrap sedition law (section 124A,IPC), a colonial hangover. "Real sedition is when those in power manipulate institutions, misuse the law, breach peace and security by inciting violence. Punish them in 2019. 'Sarkar badlo Desh bachao' (change government, save country)," Sibal said on Twitter.

Delhi Police slapped charges of sedition, rioting, and criminal conspiracy on former Jawaharlal Nehru University Students' Union (JNUSU) president Kanhaiya Kumar and nine others in a three-year-old incident which rocked the campus of India's premier seat of learning on the evening of February 9, 2016.

The JNUSU termed the charge sheeting of Kumar and nine others in the sedition case as "a clear case of vendetta" allegedly carried out at the "well-planned instruction from the Prime Minister's Office (PMO)."

Delhi Police charge sheet, running into 1,200-page and filed at the Patiala House Court on Monday, contains serious charges against Kumar and the others under various sections of the Indian Penal Code (IPC) including Section 124A (sedition), 323 (voluntarily causing hurt), 465 (forgery), 471 (using as genuine, forged document), 143 (punishment for unlawful assembly), 149 (unlawful assembly with common object), 147(rioting), and 120B (criminal conspiracy).

Delhi Police are said to have recorded the statement of more than 90 witnesses in the case. Sources said column number 12 of the charge sheet names 36 people as accused including CPI leader D Raja's daughter Aparajita Raja and former JNUSU vice president Shehla Rashid.

On February 9, 2016, "anti-national" slogans were allegedly raised on the JNU campus during a programme organised to protest against the death sentence handed out to Afzal Guru, a convict in the Parliament attack case, which led to a massive row when the members of ABVP, the student wing of RSS, objected to the programme.

 

The charge sheet names 10 students, who were enrolled into different courses of the JNU at that point of time, as main accused including Kanahiya Kumar, Umar Khalid, Anirban Bhattacharya, and seven Kashmiri students-Aquib Hussain, Mujeeb Hussain, Muneeb Hussain, Umar Gul, Rayeea Rasool, and Bashir Bhat.

 

According to information, the Delhi Police have used the video-footage and other documents to support their points in the charge sheet, which has been filed almost after three years the incident.
