Act fast on Amrapali or face jail, babus told

The SC was told that houses of 42,000 buyers have been stuck despite paying for the residential units

The Supreme Court said on Tuesday it will tolerate no delay in handing over possession to homebuyers of Amrapali housing projects and threatened to send officials of Noida and Greater Noida to jail if they fail to abide by this order.

Taking up the case for compliance after its judgment of July 23, the bench of Justices Arun Mishra and UU Lalit wished to know from the state what it had done to ensure timely delivery of flats. The UP government informed the Court that a special cell had been created to process the cases pertaining to 42,000 homebuyers whose house got stuck even though they made timely payments towards construction.

The Court in its judgment had cancelled the registration of Amrapali under the Real Estate Regulatory Authority (RERA) Act and ordered public enterprise National Building Construction Corporation (NBCC) to complete the pending projects at eight per cent commission.

Making its intention clear that it will brook no further delay in handing over of flats to the homebuyers, the bench asserted that they are not "paper tigers" and the officials concerned, if found guilty of delay, shall be sent to jail for contempt.

Meanwhile, the NBCC produced before the Court a demand for Rs 7.59 crore, the cost it incurred for completing work on two Amrapali projects. The bench reserved orders. The court-appointed receiver senior advocate R Venkatramani was also present. As all Amrapali properties came to vest in him, Venkatramani requested the SC to frame guidelines on implementation of the SC order.

For the homebuyers, an application was moved by advocate ML Lahoty who claimed that Amrapali Directors need to deposit Rs 100 crore on account of the mutual fund securities and life insurance policies purchased by them out of the money invested by homebuyers. The Court had directed all parties who were beneficiaries of the homebuyers' money to return the money within a month. This period expires on August 23.
