Committee of Administrators approaches Supreme Court again for clarification

Embarrassed by recent Supreme Court orders where BCCI's Committee of Administrators (COA) was given a rap on its knuckles by allowing state cricket associations to go ahead with elections, the Vinod Rai-led panel has moved the court again on Monday to seek clarification on two counts.

COA has submitted that SC's latest ruling has "erroneously construed in such a manner so as to override the principal judgment dated 18th July, 2016 and 9th August, 2018". Rai & Co has particularly mentioned states like Tamil Nadu and Haryana as non-complaint bodies who are yet to adhere to Justice Lodha panel recommendations and have not submitted the new constitution in line with SC directions.

The COA, thereby, asked the apex court to clarify/modify last Friday's orders to ensure that "TNCA be limited only to the five posts mentioned and approved in the BCCI constitution and not that of additionally proposed Assistant Secretary post".

DNA has reliably learnt that both TNCA and Haryana have discussed and are in process of submitting their amended constitutions with amicus curiae PS Narasimha.

"We will ensure that SC directions are fully complied with while conducting the new elections as per September 20 directions. The court has made it amply clear that 'entire election process has to be as per new BCCI constitution or else court can undo the results'," said a senior state official citing orders of bench consisting Justice SA Bobde and L Nageswara Rao.

It must be mentioned here that as per previous constitution applied in various state bodies, there was a provision to have more than one vice-president in the body. However, the newly-registered constitution of BCCI specifically spelt out that "there can't be more than a single post of VP".

TNCA, as is apparent by COA application, is keen to create a new post of Assistant Secretary. And, that's an issue that COA has been trying to bring before the apex court.

"Suppose, if there are more posts than what SC has already specified, then that will anyway be termed as null and void. Why waste time on such an issue. It looks like someone in the committee is again trying to create confusion by asking to review the latest orders," rued an official.

Going by the fact that Justice Bobde, who is hearing this matter, is part of the Ayodhya bench, the possibility of an urgent hearing is bleak.

However, sources indicated that owing to the urgency where TNCA elections are slated for Thursday, the bench could take up the matter anytime.
