The apex court's observation came after Attorney General KK Venugopal objected to Dhanda's petition submitting that an investigation was already in progress against Modi. After the update given by the top law officer, the three-judge bench led by Chief Justice of India Dipak Misra turned their attention to Dhanda.

Dhanda argued that the matter needed to be addressed and notice issued and submitted that the AG was simply defending the Centre by objecting to his petition. However, CJI Misra shot down his argument saying that the AG does not support the government in all cases.
