PNB Fraud: Interpol to decide on Red Corner Notice against Mehul Choksi next month

Choksi and Modi have allegedly swindled Rs 13,000 crore, making it possibly the biggest banking scam in the country.

Indian agencies are worried about the pending Red Corner Notice (RCN) request against fugitive billionaire Mehul Choksi as the matter is to be taken up by an internal committee of the Interpol in October. The RCN request was put on hold by the Interpol, also known as 'International criminal police organisation', after it sought clarifications on the money laundering case against Choksi.

The Interpol has raised objections to the case against Choksi being mixed up with that of Nirav Modi though the two individuals and their companies operated independently. The Indian agencies never shared specific allegations against Choksi and his role in money laundering. On the other hand, Choksi made a representation before Interpol during which he had alleged that the cases against him were a result of a political conspiracy. He also said the jails in India are not good and staying there would violate his human rights.

"Now, a five-member Interpol committee's court, called Commission for Control of Files, which will meet next month would examine contentions of both the sides and give its ruling on the request for issuing Red Corner Notice against him," said a CBI officer.

Also, CBI is waiting for a response from the government of Antigua and Barbuda over their request to arrest Choksi and start the extradition process.

A letter from the agency stated, "Since the location and nationality of Mehul Choksi are already known, he should be arrested and Antigua government should start with his extradition process."

CBI had stated that India can seek extradition of Choksi without an Interpol Red Corner Notice as it is not a mandatory requirement for the process. CBI said an RCN is of little value now as Antigua has granted him citizenship.

"The contention of Antiguan authorities that the only way the movement of Choksi could be restricted is through issue an RCN is not legally sound as the primary objective of locating the subject has already been addressed," the letter said.

However, Antigua authorities are waiting for Interpol's response and whether an RCN would be issued against Choksi or not.

He escaped the country on January 4 on an Indian passport and took the oath of allegiance in Antigua and Barbuda on January 15 this year. Choksi and Modi have allegedly swindled Rs 13,000 crore, making it possibly the biggest banking scam in the country.

The CBI Stand

CBI had stated India can seek extradition of Choksi without an Interpol Red Corner Notice as it is not mandatory. CBI said an RCN is of little value now as Antigua has granted him citizenship.
